Please read these Terms and Conditions carefully before using this site, as they explain your legal rights and your obligations to Foodadit.  By using this site, or submitting any contributions you signify your acceptance of these Terms and Conditions.

1. Accessing This Site

1.1 Your access to and use of this site is subject to these Terms and Conditions at all times.

1.2 Foodadit will not be responsible for any loss or damage arising from your failure to comply with the requirements of this section 1.

2. Using This Site

2.1 We may include information about alternative ingredients to consider in recipes posted on this site.

2.2 We are not a medical site and do not hold ourselves out as in any way medically approved, this site simply contains recipes and information for users on this site. You are advised to exercise caution at all times. If you are unsure as to whether a particular recipe or any of the suggested ingredients for any recipe are suitable for your particular dietary requirements, you should consult your doctor or a food nutritionist with relevant medical qualifications before using the recipes or ingredients concerned.

2.3 You acknowledge that Foodadit may from time to time discontinue or cancel any promotions or functionality made available on or via the site and we accept no liability for any loss or damage suffered by you as a result of any such discontinuation or cancellation.

2.4 We may make available certain functionality on this site, but such functionality shall be made available as is and we make no representation or warranty as to the application or availability of any such functionality.

2.5 We may from time to time make available companion mobile applications to complement the functionality and services offered on this site.  These Terms and Conditions shall be taken as applying to any activities or services offered on or via any such applications.  Foodadit may, in conjunction with its partners, introduce additional mobile applications from time to time, and in such circumstances the use of those applications shall be subject to such additional terms of use as may be required to supplement these Terms and Conditions.  In the event of any conflict between those supplementary terms of use and these Terms and Conditions, those terms of use shall take precedence.

2.6 Your use of this site is subject to your compliance with these Terms and Conditions at all times.

3. Conduct

3.1 You represent and warrant that you will not:

• do anything which could in any way harm or damage the site or which could cause offence to others;

• use this site (or any other information) obtained from or via the site to operate a service bureau or other revenue-generating service business (whether in competition with Foodadit or otherwise);

• attempt to gain unauthorised access to other computer systems via the site or obtain (or attempt to obtain) any materials or information through any means not intentionally made available or provided for the benefit of users on this site;

• reverse engineer or decompile, disassemble or otherwise reduce any machine-readable part of the site or any of its component parts to human-readable form;

• create or attempt to create, by reverse engineering or otherwise, the source code or internal structure of this site or any of its component parts;

• remove any product identification, legend or notices of any proprietary or copyright restrictions from any part of the site;

• list or otherwise display or copy any object code underlying this site or any of its component parts;

• do or omit to do anything which may bring Foodadit, this site or any of Foodadit’s partners (or their products) into disrepute.

4. Rights and Ownership

You acknowledge and agree that between you and Foodadit, Foodadit (or its licensors) owns any and all rights (including intellectual property rights) in or relating to this site (including all pictures and content on the site) and any companion Foodadit application, including in each case their look and feel, design and architecture and all related software, codes and algorithms.

5. Data Protection

Personal data you submit to us will be processed in accordance with our Privacy Policy.

6. Third Party Sites and Applications

Foodadit may provide links to third party websites, social media sites, online resources or applications (the Third Party Offerings). As Foodadit has no control over such sites or resources, you acknowledge and agree that Foodadit is not responsible for the availability of any such Third Party Offerings, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials available on or via those Third Party Offerings. You also acknowledge and agree that Foodadit shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such site or resource.

7. Termination and Suspension

Without adversely affecting the application of any other provisions in these Terms and Conditions, you acknowledge and agree that your access to this site is subject to your compliance with these Terms and Conditions.  If you are in breach of these Terms and Conditions or do not agree to comply with these Terms and Conditions you must cease accessing the site immediately.

8. Limitation of Liability / Disclaimers  

8.1 In no event will Foodadit be liable for any indirect, losses or for exemplary damages or for any direct or indirect loss of profits, goodwill, use, data or other such losses, including without limitation any such loss or damages arising out of or in any way connected with: (1) the use of Foodadit or any delay or inability to use Foodadit, or (2) any information, materials, data or services provided or obtained via Foodadit, or (3) Foodadit’s discontinuation of Foodadit, whether based on contract, tort, strict liability or otherwise, and even if Foodadit has been advised of the possibility of such losses or damages.

8.2 Nothing in these terms and conditions shall exclude or limit any liability for death or personal injury arising from negligence or fraudulent misrepresentation.

8.3 In any event, Foodadit’s liability to you in relation to any matter arising under or in relation to these terms shall be limited to £100.

8.4 Foodadit shall not be in breach of these Terms and Conditions nor bear any responsibility or liability for any losses arising out of any delay or failure in the performance of its obligations under these Terms and Conditions due to events beyond its reasonable control.

9. General

9.1 If any provision of these Terms and Conditions is deemed to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions, shall be enforced to the fullest extent allowed by law as to effect the intention of the parties and shall not affect the validity and enforceability of any remaining provisions.

9.2 These Terms and Conditions shall be governed by and construed in accordance with the laws of England. You hereby agree to the exclusive jurisdiction of the Courts of England regarding any and all disputes relating to or arising from these Terms and Conditions or your use of this site.
